JOB SUMMARY:

The Compliance Officer will be responsible for overseeing all aspects of regulatory compliance within the dispensary. This includes monitoring and implementing policies and procedures that align with industry standards and legal requirements. The ideal candidate will have strong attention to detail, excellent communication skills, and a passion for the cannabis industry.


RESPONSIBILITIES:

Licensing and Permits: 

State Licenses: 

  • Obtain the necessary state licenses for processing, and distribution of cannabis. This varies by state.

Local Permits: 

  • Secure local business permits, zoning permits, and any additional licenses required by city or county governments.


Regulatory Compliance:   

Follow State Cannabis Regulations: 

  • Ensure compliance with state laws concerning product labeling, packaging, testing, and advertising. 

Health and Safety Standard: 

  • Adhere to any health guidelines specific to the handling and sale of cannabis products.


Security Measures:

Facility Security:

  • Implement security measures like surveillance cameras, alarm systems, and secure storage areas to prevent theft and ensure safety.

Access Controls: 

  • Limit access to critical areas of the dispensary and maintain a log of personnel who enter secured areas.


Financial Compliance:

Banking and Financial Regulations: 

  • Be aware that cannabis remains illegal federally in the U.S., making banking and financial services more complicated. 
  • Work with banks or credit unions that are cannabis-friendly.


Tax Compliance: 

  • Understand and comply with tax obligations, including IRS Section 280E, which limits tax deductions for businesses trafficking in controlled substances.


Regulatory Compliance:

  • Ensure all operations comply with local, state, and federal laws and regulations regarding cannabis distribution and sales.
  • Stay current with changes in legislation and industry standards to provide guidance to management.


Advertising and Marketing Compliance:

Advertising Regulations: 

  • Comply with local and state advertising laws. 
  • This often includes restrictions on promoting minors or making unverified health claims.

Branding and Labeling:  

  • Ensure that product labeling meets all state-specific requirements, including ingredient disclosure and health warnings.


Policy Development: 

  • Develop, implement, and maintain compliance policies and procedures.
  • Create training materials and conduct training sessions for staff on compliance issues.


Audits and Monitoring:

  • Conduct regular audits of dispensary operations to ensure compliance with regulations and company policies.
  • Identify areas of risk and recommend corrective actions.


Reporting:

  •   Prepare and submit required compliance reports to regulatory agencies.
  •   Maintain accurate records of compliance activities and audits.


Qualifications:

  • Bachelor’s degree in business, law, or a related field (preferred).
  • Previous experience in compliance, regulatory affairs, or a similar role; experience in the cannabis industry is a plus.
  • Knowledge of local, state, and federal cannabis laws and regulations.
  • Strong analytical skills and attention to detail.
  • Excellent written and verbal communication skills.
  • Ability to work independently and collaboratively in a fast-paced environment.
  • Proficient in Microsoft Office Suite and compliance management software.
