Position Overview

The Litigation Attorney will manage a substantial caseload of DBA and related federal workers’ compensation matters, including claims at the Office of Workers’ Compensation Programs (OWCP) level and matters proceeding before the Office of Administrative Law Judges (OALJ). This attorney must be exceptionally detail-oriented, capable of managing competing deadlines, and confident taking ownership of legal strategy, evidentiary development, written advocacy, client counseling, negotiation, and hearing preparation.

Core Responsibilities

  • Manage a high-volume caseload from assignment through resolution while maintaining individualized client service.
  • Evaluate claims, defenses, medical evidence, vocational evidence, employment and wage records, prior statements, and procedural history.
  • Develop and implement case strategy, including evidence plans, discovery priorities, expert needs, and settlement posture.
  • Prepare pleadings, motions, discovery, briefs, position statements, hearing submissions, and substantive client correspondence.
  • Represent clients in conferences, mediations, depositions, hearings, and other administrative proceedings.
  • Prepare clients and witnesses for depositions, medical examinations, vocational evaluations, and testimony.
  • Track and meet all OWCP, OALJ, discovery, evidentiary, and internal deadlines.
  • Identify legal and factual weaknesses early and develop practical plans to address them.
  • Coordinate with paralegals, case managers, medical providers, experts, vendors, interpreters, and coverage counsel.
  • Negotiate strategically with opposing counsel and carriers while protecting client interests.
  • Maintain complete, accurate, and contemporaneous case notes and electronic files.
  • Use firm-approved technology to streamline authorized administrative work while personally verifying legal analysis, citations, facts, and final work product.

Required Qualifications

  • Active bar admission and good standing in at least one U.S. jurisdiction.
  • Meaningful litigation, administrative law, workers’ compensation, or comparable case-management experience.
  • Excellent legal research, writing, oral advocacy, negotiation, and strategic analysis skills.
  • Demonstrated ability to manage numerous active matters and overlapping deadlines.
  • Exceptional attention to detail and commitment to accurate, source-supported work.
  • High ethical standards, discretion, and commitment to claimant representation.

Preferred Qualifications

  • Direct experience with DBA, NAFI, Longshore Act, OWCP, OALJ, or Benefits Review Board matters.
  • Claimant-side litigation experience.
  • Experience with depositions, expert evidence, mediations, hearings, and settlement negotiations.
  • Experience working in a remote law firm and using electronic case management systems.

Compensation and Position Details

  • Salary range: $150,000–$200,000.
  • Full-time, fully remote position.
  • Attorneys are expected to be available during standard business hours from 9:00 a.m. to 5:00 p.m. Central Time, Monday through Friday.
