Expatiate Communications is seeking a highly skilled and dedicated Special Education Attorney to join our team on a contract per diem basis. The successful candidate will provide expert legal representation and advocacy to clients across California, ensuring compliance with federal and state special education laws. This role involves working with academic contracts for special education services, handling a variety of matters related to students with disabilities, and collaborating with diverse stakeholders. The Special Education Attorney will also work closely with our sales team and advise on legal considerations related to the company's business development, including out-of-state contracts. The position may require per diem work and travel.

Responsibilities:
- Provide legal advice and representation to Expatiate Communications, Inc. regarding a wide range of special education matters.
- Review, draft, and negotiate due process filings, mediation and settlement agreements contracts for special education services, ensuring compliance with legal requirements and client needs.
- Represent clients in IEP meetings, mediations, due process hearings, and other administrative proceedings.
- Advocate for clients’ rights to a Free Appropriate Pubic Education (FAPE) in the least restrictive environment (LRE).
- Conduct legal research and analysis of federal and state special education laws, including the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act (ADA).
- Prepare legal documents, including complaints, due process requests, motions, briefs, and settlement agreements.
- Communicate effectively with clients, parents, school districts, SELPAs (Special Education Local Plan Areas), LEAs (Local Education Agencies), and other relevant parties.
- Providing training and consultation to our clients and stakeholders on special education law and best practices.
- Work collaboratively with other professionals, including educational consultants, advocates, and related service providers.
- Collaborate with the company’s sales team to provide legal guidance on service offerings and ensure compliance with special education laws in various states.
- Advise company leadership on legal issues related to business development and out-of-state contracts, including compliance with state-specific regulations and requirements.
- Exercise independent legal judgment in evaluating complex special education issues and determining appropriate legal strategies.
- Analyze and apply federal and state special education laws independently, delivering case-specific legal guidance and strategic counsel.
- Perform per diem work as needed, which may include travel to various locations.

Knowledge, Skill & Other Requirements:
Qualifications:
- Juris Doctor (J.D.) degree from an accredited law school.
- Admission to the State Bar of California (admission to multiple state bars- preferred).
- Minimum of 3 years of experience practicing special education law.
- Strong understanding of federal and state special education laws, including IDEA, Section 504, and ADA.
- Experience working with academic contracts for special education services.
- Experience working with SELPAs and LEAs in multiple states (preferred but not required).
- Knowledge of alternative dispute resolution (ADR) processes in multiple states (preferred but not required).
- Experience in special education litigation (preferred but not required).
- Proven ability to represent clients in IEP meetings, mediations, and due process hearings.
- Excellent legal research, writing, and analytical skills.
- Strong communication, advocacy, and negotiation skills.
- Ability to manage a multi-state caseload and work independently.
- Demonstrated ability to exercise independent legal judgment and manage legal matters.
- Ability to work effectively with diverse populations and stakeholders.
- Willingness to travel and perform per diem work as required.
- Knowledge of the legal and regulatory landscape of special education across multiple states.
